Terms of Service

1. Who we are

BeyondATS is an AI-assisted resume analysis and rewriting tool. We help candidates measure how their CV is likely to perform against an Applicant Tracking System (“ATS”) and rewrite it to improve that performance. References to “we,” “us,” or “BeyondATS” in these Terms refer to the operator of the Service.

2. Eligibility

You must be at least 16 years old to create an account. By using the Service you represent that you have the legal capacity to enter into these Terms in your jurisdiction. If you are using the Service on behalf of an organisation, you represent that you are authorised to bind that organisation, and references to “you” in these Terms include that organisation.

3. Your account

Authentication is handled through Google or email/password sign-in. You are responsible for keeping your account credentials secure and for any activity carried out under your account. Notify us immediately at the contact address below if you believe your account has been accessed without authorisation.

4. Credits and the free tier

The Service is metered in credits. One credit equals one action — either an analysis of a resume against a job description, or one auto-revision pass. Credits behave as follows:

• Free trial. Every new account receives a one-time allotment of two (2) analysis credits and one (1) revision credit on first signup, so you can run the full loop before any commitment. The trial is granted once per person; we use coarse fingerprinting (IP-derived hash) to limit obvious abuse.
• Recurring free tier. Verified candidates between jobs receive a recurring credit grant on top of the trial. Verification is reviewed at our discretion; we may revoke free-tier access if information you provided is materially inaccurate.
• Paid packs. Credits purchased in a pack are valid for the period stated on the pack — three (3) months for the Starter Pack, twelve (12) months for larger packs. Unused credits expire at the end of that period and are not refundable except as required by law (see also our Right of Withdrawal).
• Burn order. When you trigger an action, free credits are consumed before paid credits.
• No subscriptions. We do not auto-renew or auto-charge. Every paid purchase is a discrete one-time transaction.

5. Acceptable use

You agree not to:

• upload material that you do not have the right to use, including another person's CV without their consent;
• use the Service to fabricate qualifications, employment history, or credentials;
• attempt to reverse-engineer the scoring engine, scrape model outputs at scale, or interfere with rate limits;
• use the Service in violation of applicable laws (including export controls, employment-discrimination laws, and the Personal Data Protection Act);
• submit content that is unlawful, defamatory, obscene, or that infringes intellectual-property rights.

6. AI output — important limitations

BeyondATS produces AI-generated suggestions. The output is intended as an editorial aid, not a guarantee. In particular:

• We do not guarantee that you will receive an interview, an offer, or any specific outcome from any employer or ATS.
• Every AI-injected phrase in a revision is flagged for your review. You are responsible for verifying that every claim in your final CV is accurate before submitting it to a third party.
• ATS Probability and Match Score are calibrated estimates, not the actual scoring used by any third-party recruiting software.

7. Your content

You retain ownership of the resumes, job descriptions, and other content you submit (“Your Content”). You grant us a limited, non-exclusive licence to process Your Content for the sole purpose of operating the Service for you — including running analyses, generating revisions, and storing version history in your account. This licence ends when you delete the relevant content or your account.

We do not use Your Content to train the underlying language model. See our Privacy Policy for full detail on what is stored, where, and for how long.

8. Our intellectual property

The Service — including the BeyondATS name and logo, the user interface, the scoring methodology, and the AI prompt scaffolding — is owned by us and our licensors and is protected by copyright, trademark, and other laws. These Terms grant you no rights in our intellectual property other than the limited right to use the Service as intended.

9. Payments and refunds

Paid credit packs are charged at the price displayed at checkout in the currency shown. Taxes are added where required by local law. For consumers in jurisdictions that grant a statutory cooling-off period, please see our Right of Withdrawal page. Outside that period, paid credits are non-refundable except in cases of material technical failure that prevents you from using the Service for an extended period — please contact us first and we will try to make it right.

10. Suspension and termination

You can stop using the Service at any time and delete your account from the in-app account settings. We may suspend or terminate access if we reasonably believe you have breached these Terms, attempted fraud, or used the Service to harm another person. Where the breach is curable we will give notice and a reasonable opportunity to cure first.

11. Service availability

The Service is provided on an “as is” and “as available” basis. We do not warrant uninterrupted, error-free operation, but we do operate the Service in good faith and aim for high availability. Scheduled maintenance and emergency fixes may cause short outages.

12. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the Service is limited to the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) US $50. We will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost business opportunity. Nothing in these Terms limits any liability that cannot be limited by law (such as liability for fraud or wilful misconduct).

13. Indemnity

You agree to indemnify and hold us harmless from any claim brought by a third party arising out of (a) Your Content, (b) your breach of these Terms, or (c) your violation of any law or third-party right.

14. Changes to these Terms

We may update these Terms from time to time. When we make a material change, we will update the “Last updated” date above and, where the change is significant, notify signed-in users by email or an in-app notice. Continued use of the Service after the change takes effect constitutes acceptance.

15. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which BeyondATS is operated, without regard to conflict-of-laws principles. Where you are a consumer, this clause does not deprive you of the protections of mandatory law in your country of residence. Any dispute will first be raised through our contact form so we can try to resolve it amicably; failing that, the courts of our place of operation will have non-exclusive jurisdiction.
